These Terms of Service ("Terms") govern your use of FNSHD, an addiction recovery coaching application published by Nereus Data ("we," "us," or "our") for iPhone (the "App").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

FNSHD is a wellness and recovery coaching application designed to support individuals seeking to overcome pornography addiction. The App provides a structured 90-day recovery program, daily check-ins, journaling tools, an AI-powered recovery coach, and educational curriculum.

FNSHD is a wellness support tool, not a medical device, licensed therapist, or mental health treatment provider. The App does not provide medical advice, psychological diagnosis, or clinical treatment. Always consult a qualified mental health professional, therapist, or physician for medical or psychiatric concerns.

3. Eligibility

You must be at least 17 years of age to use the App, consistent with its App Store content rating. By using the App, you represent and warrant that you meet this age requirement. If you are a minor, you must have your parent or legal guardian's consent.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

5. Subscriptions and Purchases

Pricing

Some features require a paid subscription. Available plans include weekly, monthly, annual, and lifetime options. Current pricing is displayed within the App and on the App Store listing, and is subject to change with advance notice.

Billing

All subscriptions are billed through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase. We do not process payments directly and do not have access to your payment information.

Auto-Renewal

Recurring subscriptions (weekly, monthly, annual) automatically renew unless canceled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions). Cancellation takes effect at the end of the current billing period. Canceling does not provide a refund for the current period.

Refunds

Refund requests must be directed to Apple, as all purchases are processed through the App Store. Visit reportaproblem.apple.com to request a refund.

Lifetime Access

A one-time lifetime purchase grants access to all current premium features indefinitely for the purchasing Apple ID. Lifetime access does not guarantee future features or continued App availability.

6. Apple's Standard EULA

Use of the App is also governed by Apple's Standard Licensed Application End User License Agreement ("Standard EULA"), available at Apple's Standard EULA. In the event of a conflict between these Terms and the Standard EULA, these Terms shall control to the extent permitted by applicable law.

The App includes an AI-powered recovery coach ("AI Coach") that provides conversational support. Important terms governing this feature:

The App may use Apple's Screen Time and Family Controls frameworks to provide content-blocking features. Use of these features requires granting the App the appropriate entitlement permissions on your device. These features operate locally on your device and do not transmit your usage data to our servers.

The App, including its design, code, curriculum content, branding, and user interface, is owned by Nereus Data and protected by applicable intellectual property laws. All rights not expressly granted are reserved.

Your privacy is important to us. Please review our Privacy Policy for details on how we handle information. In summary: recovery data is stored locally on your device, AI coach messages are processed in transit and not retained on our servers, and we do not sell or share your personal data.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF CONTENT.

We do not warrant that the App will be uninterrupted, error-free, or continuously available. We do not warrant the accuracy, completeness, or therapeutic effectiveness of any content, program materials, or AI-generated coaching responses.

Recovery outcomes vary by individual. Nereus Data makes no guarantee that use of the App will result in recovery from addiction or any particular behavioral outcome.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEREUS DATA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, EMOTIONAL DISTRESS, RELAPSE, OR INTERRUPTION OF RECOVERY PROGRESS.

Our total liability for any claim related to the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Nereus Data and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or your violation of these Terms.

15. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms or abuse of our systems. Upon termination, your license to use the App is revoked. Provisions that by their nature should survive termination (including Sections 12, 13, and 14) will continue to apply.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the courts of competent jurisdiction in Delaware.
